These Terms of Use, together with any policies, rules, disclosures, consent language, and agreements incorporated by reference, including our Privacy Policy and E-SIGN Consent, govern your access to and use of the ePinionCenter.com website, panel platform, dashboards, survey invitations, research opportunities, reward programs, communications, and related services.

ePinionCenter.com is owned and operated by Market Knowledge Online, doing business as ePinionCenter. In these Terms, “ePinionCenter,” “Market Knowledge Online,” “we,” “us,” and “our” refer to Market Knowledge Online d/b/a ePinionCenter. “You,” “your,” “member,” “panelist,” or “user” refers to any person who registers for, accesses, or uses the ePinionCenter platform.

By creating an account, checking an agreement box, clicking “Continue,” “Continue to Create My Account,” “Submit,” “Join,” “Register,” or any similar button, accessing your account, participating in surveys, redeeming rewards, or otherwise using the platform, you agree to these Terms.

If you do not agree to these Terms, do not register, access, or use ePinionCenter.

1. Eligibility

You may register for and use ePinionCenter only if you:

  1. are a legal resident of the United States;
  2. are at least eighteen years old;
  3. are legally capable of entering into a binding agreement;
  4. provide accurate, current, and complete registration information;
  5. maintain only one account unless we expressly authorize otherwise in writing; and
  6. comply with these Terms, our Privacy Policy, and all applicable laws.

ePinionCenter is not intended for children or minors. We do not knowingly permit individuals under eighteen to register or participate. If we determine or suspect that a user is under eighteen, we may suspend or terminate the account and delete or restrict related information as permitted or required by law.

We may require verification of your identity, age, residency, phone number, email address, payment account, tax information, or other account details before allowing account access, survey participation, or reward redemption.

2. Account Registration and Security

To participate in ePinionCenter, you may be required to create an account and provide information such as your name, email address, phone number, mailing address, demographic profile, household information, survey preferences, payment or redemption information, and other information relevant to market research participation.

You agree that all information you provide is truthful, accurate, complete, and not misleading. You are responsible for keeping your account information current.

You are solely responsible for maintaining the confidentiality of your username, password, login credentials, and account access. You may not sell, transfer, assign, lend, share, or permit another person to use your account.

You agree to notify us promptly if you believe your account has been accessed without authorization, your login credentials have been compromised, or any suspicious activity has occurred. We are not responsible for losses caused by your failure to secure your account.

3. Panelist Profile and Survey Matching

Survey opportunities may be based on your profile information, demographic data, prior survey activity, geographic location, device information, advertiser or research-client criteria, fraud-screening data, and other eligibility requirements.

You are not guaranteed to receive any particular number of surveys, survey invitations, rewards, points, cash, promotional offers, or research opportunities.

A survey invitation does not guarantee that you will qualify for, complete, or be compensated for that survey. You may be screened out, disqualified, redirected, or terminated from a survey at any time based on survey criteria, quality checks, quota limits, inconsistent answers, duplicate responses, technical issues, suspected fraud, or client requirements.

4. Panelist Conduct

You agree to use ePinionCenter honestly, lawfully, and only for legitimate personal participation in market research.

You may not:

  1. create, maintain, or attempt to use more than one account;
  2. register using false, misleading, incomplete, or third-party information;
  3. impersonate another person or misrepresent your identity, age, location, household, employment, income, health status, consumer habits, or any other survey-relevant information;
  4. use bots, scripts, automation tools, macros, VPN manipulation, proxy masking, emulators, disposable phone numbers, fake emails, virtual devices, artificial traffic, click farms, or other deceptive methods;
  5. provide random, rushed, inconsistent, duplicate, nonsensical, fabricated, AI-generated, or low-quality survey answers;
  6. attempt to complete surveys for which you are not eligible;
  7. share survey links, invitation links, panel access links, or redemption links with others;
  8. attempt to manipulate survey qualification, tracking, points, rewards, referrals, or redemption systems;
  9. engage in chargeback abuse, payment fraud, identity fraud, tax-reporting fraud, or redemption fraud;
  10. use another person’s device, phone number, email address, payment account, or identity without authorization;
  11. interfere with the website, survey platform, tracking systems, servers, security features, or fraud-prevention tools;
  12. reverse engineer, scrape, crawl, copy, harvest, or extract platform data, survey content, user data, or proprietary information;
  13. upload malware, spyware, malicious code, or harmful files;
  14. harass, threaten, abuse, or interfere with ePinionCenter personnel, support staff, clients, vendors, advertisers, partners, or other users;
  15. violate any applicable law, regulation, rule, or third-party right.

We may use manual review, automated systems, fraud logs, device fingerprinting, IP analysis, behavioral scoring, survey-quality checks, third-party compliance tools, advertiser feedback, and other methods to detect conduct that violates these Terms.

5. Rewards, Points, Incentives, and Redemptions

ePinionCenter may offer points, cash, gift cards, sweepstakes entries, promotional credits, referral bonuses, or other incentives for eligible participation in surveys, research activities, profile updates, promotional campaigns, or other approved activities.

Rewards are subject to the specific rules, payout amounts, timing, eligibility criteria, and redemption requirements displayed on the platform or in a survey invitation at the time of participation.

Unless otherwise stated:

  1. points have no cash value until approved and redeemed through our authorized redemption process;
  2. points and rewards are promotional incentives only and do not create a bank account, stored-value account, wage relationship, employment relationship, property interest, or vested right;
  3. rewards are not transferable, assignable, sellable, inheritable, or redeemable except as expressly permitted by us;
  4. we may require a minimum balance before redemption;
  5. we may verify your account, survey activity, identity, residency, phone number, email address, payment account, and tax information before approving any redemption;
  6. redemptions may be delayed, denied, reversed, adjusted, canceled, or charged back if we suspect fraud, duplicate accounts, ineligible participation, inaccurate information, technical error, client rejection, quality-control failure, or violation of these Terms;
  7. we may correct reward balances, point balances, payment errors, duplicate credits, overpayments, or mistaken postings at any time.

We are not responsible for delays caused by payment processors, gift card providers, banks, third-party reward vendors, survey clients, inaccurate account information, fraud reviews, tax compliance, technical issues, or events outside our reasonable control.

6. Reward Expiration and Account Inactivity

We may establish expiration rules for points, credits, rewards, or account balances. Unless a different rule is posted on the platform, points or rewards may expire if your account is inactive for twelve months or longer.

“Inactive” means that you have not logged into your account, completed a qualifying survey, updated your profile, redeemed rewards, or otherwise engaged in account activity recognized by ePinionCenter.

We may provide notice of inactivity or expiration where required by law, but you are responsible for monitoring your account and reward balance.

If your account is terminated for fraud, abuse, duplicate registration, violation of these Terms, or other misconduct, all pending, accrued, or unredeemed rewards may be forfeited immediately, subject to applicable law.

7. Referral Programs and Promotional Offers

We may offer referral bonuses, sweepstakes, contests, limited-time promotions, or special incentives. Each promotion may be subject to separate rules, eligibility requirements, deadlines, limits, exclusions, and verification procedures.

Referral credit may be denied, reversed, or forfeited if the referred user is fake, duplicate, ineligible, inactive, fraudulent, self-referred, generated through paid traffic without authorization, or otherwise violates these Terms.

We may modify, suspend, or terminate any referral program or promotion at any time.

8. Taxes

You are solely responsible for any federal, state, local, or other taxes, reporting obligations, or payment obligations arising from rewards, incentives, prizes, redemptions, or other benefits received through ePinionCenter.

We may require you to provide tax documentation, including a completed IRS Form W-9, before processing certain payments or once payment thresholds are met. We may withhold or deny payments if required tax information is not provided.

9. Communications Consent

By registering for ePinionCenter, you agree that we may send you account-related communications, survey invitations, research opportunities, reward notices, redemption updates, administrative messages, fraud-prevention notices, support responses, and other service-related communications.

Where you provide marketing consent, including through a checkbox, electronic signature, signup form, lead form, or similar process, you authorize ePinionCenter, Market Knowledge Online, and, where disclosed, selected affiliates, service providers, advertisers, research partners, and marketing partners to contact you using the contact information you provide.

Such communications may include email, telephone calls, text messages, SMS, MMS, prerecorded messages, artificial voice, AI-generated voice, or communications made using an automatic telephone dialing system, subject to your consent and applicable law.

You understand that consent to marketing calls or texts is not required to register, participate in surveys, receive services, or use ePinionCenter. Message and data rates may apply. Message frequency may vary.

You represent that you are the subscriber, account holder, or customary user of any telephone number you provide. You agree to promptly notify us if your phone number is reassigned, canceled, or no longer used by you.

You may opt out of marketing emails by using the unsubscribe link in an email. You may opt out of text messages by replying STOP where available. You may revoke call or text consent by making a do-not-call request during a call, contacting us through our published support channels, or using any other reasonable method.

Revoking marketing consent may limit your receipt of promotional messages, but it will not necessarily terminate your account or prevent us from sending transactional, account, security, legal, or service-related communications.

10. E-SIGN Consent and Electronic Agreements

By creating an account, checking a consent box, clicking an agreement button, submitting a form, or otherwise using ePinionCenter electronically, you consent to transact electronically with us.

You agree that your electronic signature, checkbox consent, button click, typed name, IP address, device information, timestamp, consent record, and related electronic records have the same legal effect as a handwritten signature.

You consent to receive agreements, disclosures, notices, policies, account communications, tax-related requests, reward notices, and other records electronically, including by email, website posting, account dashboard, SMS, or other electronic means.

You are responsible for maintaining a valid email address, compatible device, internet access, browser, and software capable of receiving and retaining electronic records.

You may withdraw E-SIGN consent by contacting us, but doing so may result in suspension or termination of your account if electronic communications are necessary to provide the service.

11. Consent Records, Compliance Tools, and Fraud Prevention

You understand and agree that we may record, verify, store, and use registration activity, form submission details, IP address, device information, browser information, page URL, timestamps, consent language presented, consent actions, survey activity, redemption activity, referral activity, click behavior, and related records for compliance, fraud prevention, quality control, audit, legal defense, and operational purposes.

We may use third-party tools, vendors, compliance platforms, fraud-prevention services, analytics providers, survey platforms, email service providers, SMS providers, payment processors, reward vendors, and marketing partners to operate and protect the platform.

Your use of ePinionCenter is also governed by our Privacy Policy.

12. Privacy

Our collection, use, sharing, retention, and protection of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

By using ePinionCenter, you acknowledge that you have read and understand the Privacy Policy.

If there is a conflict between these Terms and the Privacy Policy regarding how we collect, use, disclose, or protect personal information, the Privacy Policy will control as to privacy-specific matters, unless otherwise required by law.

13. Confidentiality of Surveys and Research Materials

During your participation, you may view or access confidential, proprietary, unreleased, embargoed, pre-market, or non-public materials, including product concepts, advertisements, packaging, brand names, logos, videos, claims, pricing, prototypes, scripts, software, screenshots, studies, questions, answer choices, research topics, client identities, and business strategies.

You agree to keep all such materials strictly confidential.

You may not copy, photograph, screenshot, record, download, share, publish, post, disclose, discuss, summarize, distribute, sell, or otherwise reveal survey content or research materials to any third party, including on social media, blogs, forums, review sites, messaging apps, video platforms, or AI tools.

Your confidentiality obligations continue after your survey ends and after your account is terminated.

Violation of this section may result in account termination, reward forfeiture, legal action, and liability for damages, including damages suffered by ePinionCenter, its clients, advertisers, research partners, vendors, or other third parties.

14. Intellectual Property

All content, software, technology, code, designs, text, graphics, logos, icons, images, videos, audio, survey materials, questionnaires, research concepts, databases, dashboards, templates, workflows, trademarks, service marks, trade names, branding, proprietary methods, and other materials available through ePinionCenter are owned by or licensed to Market Knowledge Online, ePinionCenter, our clients, vendors, advertisers, licensors, or research partners.

You receive only a limited, personal, revocable, non-exclusive, non-transferable license to access and use the platform for lawful panel participation in accordance with these Terms.

You may not copy, reproduce, modify, adapt, translate, distribute, display, perform, publish, license, sell, rent, exploit, scrape, reverse engineer, decompile, disassemble, create derivative works from, or otherwise misuse any portion of the platform or its content.

No rights are granted except as expressly stated in these Terms.

15. User Content and Survey Responses

You may submit survey answers, profile information, feedback, messages, support requests, comments, opinions, ratings, demographic information, and other content through ePinionCenter.

You represent that your submissions are truthful, original to you, not fraudulent, not generated by unauthorized automation, and do not violate any third-party rights.

Subject to our Privacy Policy, you grant ePinionCenter, Market Knowledge Online, our clients, research partners, vendors, advertisers, affiliates, service providers, successors, and assigns a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable right to use, analyze, aggregate, reproduce, distribute, display, modify, store, commercialize, and create derivative works from your survey responses, feedback, and submissions for research, analytics, reporting, quality control, product development, advertising, marketing, compliance, fraud prevention, and business purposes.

Survey responses are generally used in aggregated, de-identified, pseudonymized, or research-report form, except as otherwise disclosed in our Privacy Policy, survey-specific disclosures, consent language, or applicable law.

16. Third-Party Surveys, Links, Offers, and Partners

ePinionCenter may provide access to third-party surveys, research platforms, advertisers, offers, landing pages, sweepstakes, studies, websites, applications, payment processors, reward providers, or marketing partners.

We do not control all third-party content, eligibility decisions, survey criteria, survey availability, disqualification decisions, reward approvals, privacy practices, or technical systems.

Your interaction with third parties may be governed by their own terms, privacy policies, consent language, and eligibility rules.

We are not responsible for third-party websites, third-party survey platforms, third-party offers, third-party communications, third-party decisions, third-party delays, third-party errors, or third-party conduct, except where required by law.

17. Suspension, Termination, and Forfeiture

We may suspend, restrict, review, deactivate, or terminate your account at any time, with or without notice, if we believe that you have:

  1. violated these Terms;
  2. provided false, incomplete, inconsistent, or misleading information;
  3. created or used multiple accounts;
  4. engaged in fraud, abuse, automation, or manipulation;
  5. submitted low-quality, inconsistent, duplicate, or fabricated survey responses;
  6. attempted unauthorized access to the platform;
  7. violated confidentiality obligations;
  8. misused rewards, referrals, promotions, redemptions, or payment systems;
  9. created legal, regulatory, security, operational, reputational, or business risk;
  10. engaged in conduct we deem harmful to ePinionCenter, Market Knowledge Online, users, clients, vendors, advertisers, service providers, or research partners.

Upon suspension or termination, we may cancel pending rewards, reverse points, deny redemptions, close support requests, block future registration, prevent access to surveys, and forfeit unredeemed balances, subject to applicable law.

We may also terminate inactive accounts, discontinued accounts, duplicate accounts, or accounts associated with invalid contact information.

You may stop using ePinionCenter at any time. You may request account closure by contacting us through our published support channels. Account closure does not entitle you to payment of unredeemed or unverified rewards unless required by law or expressly approved by us.

18. Platform Availability and Technical Issues

We do not guarantee that ePinionCenter, any survey, any survey link, any dashboard, any reward feature, or any communication system will be uninterrupted, timely, secure, error-free, virus-free, or available at all times.

The platform may be unavailable, delayed, interrupted, limited, or affected by maintenance, updates, outages, third-party systems, internet failures, software bugs, security incidents, fraud reviews, quota closures, survey-client decisions, or events outside our reasonable control.

We are not responsible for lost survey opportunities, incomplete surveys, failed redirects, browser errors, tracking errors, delayed rewards, lost data, technical glitches, disqualifications, or inability to access the platform, except where required by law.

19. Disclaimers

ePinionCenter is provided on an “as is,” “as available,” and “with all faults” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and uninterrupted operation.

We do not guarantee that you will qualify for surveys, receive invitations, earn rewards, redeem any minimum amount, receive a particular payment method, or obtain any particular benefit from using ePinionCenter.

20. Limitation of Liability

To the fullest extent permitted by law, Market Knowledge Online, ePinionCenter, and their owners, officers, directors, employees, contractors, agents, affiliates, clients, advertisers, research partners, vendors, service providers, licensors, successors, and assigns will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost rewards, lost data, lost goodwill, business interruption, device damage, unauthorized access, or loss of survey opportunities.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to ePinionCenter, these Terms, your account, survey participation, communications, rewards, redemptions, or platform use will not exceed the greater of:

  1. the amount of verified, approved, unpaid rewards owed to you, if any; or
  2. one hundred dollars.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

21. Indemnification

You agree to defend, indemnify, and hold harmless Market Knowledge Online, ePinionCenter, and their owners, officers, directors, employees, contractors, agents, affiliates, clients, advertisers, research partners, vendors, service providers, licensors, successors, and assigns from and against any claims, damages, liabilities, losses, costs, penalties, fines, expenses, and attorneys’ fees arising out of or related to:

  1. your use or misuse of ePinionCenter;
  2. your violation of these Terms;
  3. your fraud, misconduct, or misrepresentation;
  4. your violation of confidentiality obligations;
  5. your violation of any law or third-party right;
  6. your survey responses, submissions, or user content;
  7. your use of another person’s information, device, email, phone number, payment account, or identity;
  8. your tax, payment, redemption, or chargeback issues.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with us.

22. Arbitration Agreement and Class Action Waiver

Please read this section carefully. It affects your legal rights.

You and Market Knowledge Online d/b/a ePinionCenter agree that any dispute, claim, or controversy arising out of or relating to these Terms, your account, your registration, your use of ePinionCenter, survey participation, rewards, redemptions, communications, consent, privacy-related claims to the extent permitted by law, or any relationship between you and us will be resolved by binding individual arbitration, rather than in court, except as stated below.

The arbitration will be administered by the American Arbitration Association or another mutually agreed arbitration provider under applicable consumer arbitration rules.

You and we agree that arbitration will proceed only on an individual basis. You and we waive the right to bring or participate in any class action, collective action, mass action, private attorney general action, representative action, consolidated action, or jury trial.

The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim. The arbitrator may not award relief for or against anyone who is not a party to the arbitration.

Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court.

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, platform security, fraud prevention, or unauthorized access.

If any portion of this arbitration section is found unenforceable, the remainder will remain enforceable to the fullest extent permitted by law, except that if the class action waiver is found unenforceable as to a particular claim, that claim must proceed in court and not arbitration.

Optional Arbitration Opt-Out: You may opt out of this arbitration agreement by sending written notice to us within thirty days after creating your account. Your notice must include your full name, email address associated with your account, phone number, mailing address, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration will not affect any other part of these Terms.

23. Governing Law

These Terms and any dispute arising out of or relating to ePinionCenter will be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement.

Subject to the arbitration agreement, any court proceeding that is not subject to arbitration shall be brought in the state or federal courts located in New Jersey, unless applicable law requires otherwise.

24. Changes to These Terms

We may update, revise, or modify these Terms at any time.

When we make changes, we may provide notice by posting the updated Terms on the website, updating the “Last Updated” date, sending an email, displaying an account notice, or using another reasonable method.

Your continued use of ePinionCenter after updated Terms are posted or become effective means you accept the updated Terms.

If you do not agree to updated Terms, you must stop using ePinionCenter and may request account closure.

25. Assignment

You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written consent.

We may assign, transfer, delegate, or sublicense these Terms, in whole or in part, in connection with a merger, acquisition, asset sale, corporate transaction, restructuring, change of control, or by operation of law.

26. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

27. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later. Any waiver must be in writing and signed by an authorized representative of Market Knowledge Online.

28. Entire Agreement

These Terms, together with the Privacy Policy, E-SIGN Consent, signup consent language, survey-specific rules, reward rules, promotional rules, and any other policies incorporated by reference, constitute the entire agreement between you and Market Knowledge Online d/b/a ePinionCenter regarding your use of the platform.

This E-SIGN Consent applies to your use of ePinionCenter and your electronic interactions with Market Knowledge Online d/b/a ePinionCenter.

By checking a box, clicking “Continue,” “Continue to Create My Account,” “Submit,” “Register,” “Join,” or any similar button, creating an account, participating in surveys, redeeming rewards, or otherwise using the platform, you consent to receive electronic records from us.

Electronic records may include Terms of Use, Privacy Policy, consent disclosures, survey invitations, account notices, reward notices, redemption notices, tax-related requests, fraud-prevention notices, support communications, legal notices, and other documents or communications.

You agree that electronic signatures, electronic consents, checkbox consents, typed names, button clicks, IP addresses, timestamps, device information, and consent records have the same legal effect as paper documents and handwritten signatures.

To access and retain electronic records, you need a device with internet access, a compatible browser, an active email account, and the ability to save or print records.

You may withdraw E-SIGN consent by contacting us. If you withdraw consent, we may suspend or terminate your account if electronic communications are necessary to provide the service.
